The Supreme Court on Tuesday reiterated that its decision to declare the impeachment of Vice President Sara Duterte as unconstitutional should be enforced immediately.
The High Court, in a statement, said its July 25 decision to grant the petitions by Duterte and lawyer Israelito Torreon to dismiss the fourth impeachment complaint was made “with the Justices present voting unanimously.”
“[T]he SC En Banc ruled that the impeachment complaint was void for violating the one-year ban and due process requirements. This Decision is immediately executory,” the SC said.
It acknowledged receiving the motion for reconsideration filed by the House of Representatives.
“The SC required petitioners Vice President Sara Z. Duterte and Atty. Israelito P. Torreon et al. to comment on the motion within a non-extendible period of 10 days from notice,” the SC said.
The High Tribunal likewise “noted” the motion for reconsideration filed by Akbayan party-list Rep. Percival Cendaña and others as the SC’s action on their motion for intervention remains pending.
