IPOPHL tells DALI operator to pull out 3 items from shelves

The Intellectual Property Office of the Philippines (IPOPHL) ordered the operator of DALI Everyday Grocer to pull out three products off its shelves after it determined these were “confusingly similar” to established brands produced and popularized by Nutri-Asia Inc.

Law firm Cruz Marcelo & Tenefrancia law firm announced on its website that the IPOHL issued an injunction against hard discount store DALI based on the complaint it lodged on behalf of Nutri-Asia.

The Nutri-Asia complaint involved trademark infringement, unfair competition and copyright infringement of its three popular products—UFC Banana Ketchup, Datu Puti Vinegar and Datu Puti Soy Sauce.

DALI is selling these products as KULINA banana ketchup and Raja Puro vinegar and soy sauce, whose packaging are very similar to Nutri-Asia’s UFC and Datu Puti products, the law firm said.

“During the injunction hearings, our legal team has successfully established Nutri-Asia’s IP rights over two of the Philippines’ most popular household brands against DALI. The injunction preserves Datu Puti and UFC’s well-established goodwill and reputation,” the law firm said.

Cruz Marcelo & Tenefrancia said that by virtue of the injunction, DALI pulled out the products from its stores.
