The Commission on Elections (Comelec) has now banned the use of artificial intelligence (AI) and fake social media accounts as campaign materials for candidates or political parties in the 2025 national and local elections (NLE).
Under Resolution No. 11064, Comelec said it would ban “false amplifiers” such as fake accounts and AI bots used to spread misinformation or disinformation for or against any candidate or political party.
The ban will be implemented after the Comelec en banc released on Wednesday the guidelines for the use, prohibition, and punishment of the misuse of digital campaigning technologies for the forthcoming elections.
A task force created by Comelec will file a motu proprio election offense complaint against violators before the law department. Its role is to protect the upcoming elections against AI-driven misinformation and disinformation by monitoring and regulating published content on quad-media such as TV, radio, print, and online.
“We are ready if this issue reaches the Supreme Court. The boundary is very thin, very narrow, between what is constitutional and what violates our Constitution, especially when the topic is freedom of expression and freedom of the press. Not all rights are absolute,” Comelec Chairman George Garcia said.
He said Comelec will prohibit three types of visual disinformation to prevent the spread of deceptive content during the campaign period: deepfakes, cheap fakes, and soft flakes.
“All election propaganda and campaign materials of candidates and political parties that utilize artificial intelligence technology shall be required to disclose the fact of its use, and appropriate technology is employed to identify its authenticity and legitimate source,” Comelec added.
