State employees doing night shifts get 20% pay differential

Government employees doing night shifts are now entitled to a 20 percent pay differential in their hourly basic salary.

President Duterte on April 13 signed into law Republic Act (RA) No. 11701 mandating a night shift differential pay to government employees including those in government-owned or -controlled corporations (GOCCs) working from 6 p.m. to 6 a.m.

The new law covers government workers occupying such positions as

division chief and below, or their equivalent, whether permanent, contractual, temporary, or casual.

Under RA 11701, the night shift differential pay would be in addition to and would not in any way diminish whatever benefits and allowances presently enjoyed by the affected government employees.

The hourly basic rate is computed by dividing the basic monthly rate by 22 working days and dividing the quotient derived by eight hours.

Government employees who work from 6 a.m. to 6 p.m. Are not covered by the new law. But they will be paid overtime pay if they work beyond the regular eight-hour schedule.

Also exempted from RA 11701 are government workers whose services are required or are on-call, 24 hours a day, such as the personnel of the uniformed agencies, namely, the Armed Forces of the Philippines (AFP), the Philippine National Police (PNP), the Bureau of Jail Management and Penology (BJMP), and the Bureau of Fire Protection (BFP).

The Civil Service Commission, in coordination with the DBM, was tasked 6to promulgate the implementing rules and regulations for the effective implementation of this act.

For the national government entities, the amount must be charged against existing appropriations for the purpose of the departments, bureaus, offices, and agencies concerned.

Thereafter, such sums as may be necessary for the continuous implementation of this act must be included in the annual general appropriations act.

For local government units, the amount must be charged against their respective funds, subject to the provisions of Section 325 and 331 of Republic Act No. 7160 or the Local Government Code of 1991.

For GOCCs and their subsidiaries, the amount shall be charged against their respective corporate funds.
