SC upholds the constitutionality of martial law in Mindanao

The Supreme Court has voted in favor of the imposition of martial law in Mindanao.

The justices voted 11-3-1 upholding Proclamation Number 216 signed by President Rodrigo Duterte imposing martial law and suspending the privilege of writ of habeas corpus in Mindanao.

Eleven (11) magistrates favored the imposition of martial law all over Mindanao, three (3) justices partially granted the declaration while one (1) justice opposed.

This, in effect, dismisses three of several petitions filed against the martial law order.

One of the 3 petitions was filed by opposition lawmakers in the House of Representatives.

SC Associate Justice Mariano Del Castillo wrote the decision.

Other justices are writing separate opinions.

The deadline for the submission of separate opinions is on July 5.

Duterte declared martial law in Mindanao on May 23, 2017 when the Maute terrorists invaded Marawi City.
