WESM hearing set

The Energy Regulatory Commission has set an August hearing of 12 companies charged with anti-competitive behavior that pushed up prices at the wholesale electricity spot market in November and December 2013.

ERC investing officer Isabelo Joseph Tomas II, in separate notices of pre-trial conferences, asked the 12 companies to submit their respective trial briefs, which include summary of facts, issues to be resolved and documents.

Tomas on June 10, 2015 filed 13 complaints against the companies for violation of the Electric Power Industry Reform Act of 2001.

Epira states that “no participant in the electricity industry or any other person may engage in any anti-competitive behavior including, but not limited to, cross-subsidization, price or market manipulation, or other unfair trade practices detrimental to the encouragement and protection of contestable markets.”

The regulator set the pre-trial conference on August 11, 2 p.m. at the ERC hearing room in Pasig City.
