The provincial prosecutor of Tarlac has dismissed the case filed by MINLAN RANCH through its president, Maverick Yumul, against DV BOER.
Tarlac assistant prosecutor Mila-mae Ikeshita has resolved the harassment case against DV BOER for its failure to submit its counter affidavit due to the cancellation of the preliminary investigation dated March 23 and 30, 2020.
DV Boer, upon receiving the resolution, filed a motion for reconsideration to reopen the preliminary investigation on the ground that the Department of Justice had issued a circular saying all preliminary investigations in the implementation of the enhanced community quarantine was deemed canceled and would be rescheduled after its lifting.
The lawyers of Yumul had opposed the motion filed by the respondents, hoping to bag the case in their favor. However, provincial prosecutor Aladdin Bermudes resolved that in the interest of substantial justice, the case must be decided on the basis of its merits and not on mere technicalities.
Following, the counter affidavit later filed by the respondents, a supplemental Motion for reconsideration was also admitted.
In a resolution of Bermudez, it was pointed out that, based on the evidences presented, the complainant Yumul was never defrauded and that the later had failed to prove that the respondents had committed even simple estafa.
With this harrasment case being outrightly dismissed for lack of merit, it was expected that Yumul and other former subfarms could not make any more excuses to further evade their legal and civil liabilities to their partners.
It is now anticipated that more of their partners would move to file criminal charges against Yumul and the rest of the former subfarms that turned their backs on DV Boer’s advocacy of championing Philippine agriculture to support food security and provide sustainable jobs in the country.
On the other hand, DV BOER and its subsidiaries remain faithful and committed to execute its road to recovery for all its partners, employees and stakeholders.
