The City Prosecutors Office of Taguig has ordered the filing of estafa charges against embattled businessman and publicist Nicardo Falcis II for the alleged misuse of a credit card issued to him by Cristina C. Aquino Productions Inc.
Falcis was former project manager of actress and TV host Kris Aquino, who filed the criminal case against the former.
Aquino filed charges of Estafa through Misappropriation and Conversion, and violation of Access Devices Regulation Act against Falcis.
“The Taguig-OCP found the statements of Ms Kris Aquino as credible and the evidence she adduced as sufficient to establish a prima facie case that Nicko Falcis misappropriated and converted the corporate credit card entrusted to him for his own personal expenses,” Aquino’s legal counsel in the Divina Law firm said in a statement.
Aquino’s lawyers said the prosecutors office noted the check personally delivered by Falcis to Aquino was an admission of guilt.
“The truth has finally come out and we are hopeful that all the other cases filed against Nicko Falcis will reach the courts and he will be held accountable for his crimes,” the Divina Law firm stated.
Falcis’ camp said the decision issued by the prosecutors office was unjust.
“We believe this is an unjust decision. Moreover, last November 2018, we filed a Motion for Inhibition and to Refer the Case to the Department of Justice because of certain circumstances that have led us to lose faith and confidence in the impartiality of the Office of the City Prosecutor of Taguig City. The same was not acted upon and its denial was incorporated in the Resolution of the Office of the City Prosecutor of Taguig City,” said Regi Ponferada, lawyer of Falcis.
“We will file a Motion for Reconsideration and, if necessary, we will also file a Petition for Review before the Department of Justice,” Ponferada added.
