Sem-Calaca to appeal fines imposed by ERC

Sem-Calaca Power Corp. said Thursday it will file a motion for reconsideration with the Energy Regulatory Commission which slapped fines on the company for allegedly exceeding the number of allowed unplanned outages

Semirara Mining and Power Corp. said in a disclosure to the stock exchange subsidiary SCPC would appeal the ERC decision imposing fines of P337,200 for allegedly exceeding the number of allowed unplanned outages by 5.24 days for Unit 1; and P3,975,600 for allegedly exceeding the number of allowed unplanned outages by 96.2 days for Unit 2.

“While SCPC has not received a copy of the official resolution, it intends to appeal this decision by filing a motion for reconsideration with the ERC,” SMPC said.

The ERC issued on June 24, 2021 a show cause order to SCPC for alleged violation of Article V of ERC Resolution No. 10, Series of 2020 otherwise known as the “Rules for the Interim Reliability Performance Indices and Equivalent Outage Days Per Year of Generating Units.”

It directed SCPC to explain the 22 and 113 cumulative unplanned outage days for its Sem-Calaca Unit 1 and Unit 2, respectively beyond the maximum allowable outage days for a pulverized coal-fired power plant of only 16.8 days per generation unit per year.
