Court of Appeals: No TRO for De Lima

The Department of Justice (DOJ) may now proceed with its planned release of a resolution on the criminal complaints filed against Senator Leila de Lima.

This comes, after the Court of Appeals (CA) did not issue a temporary restraining order (TRO) to stop the DOJ’s investigation into De Lima’s alleged involvement in the proliferation of illegal drugs in New Bilibid Prison (NBP) when she was justice secretary.

De Lima earlier asked the appellate court to come out with the TRO and writ of preliminary injunction.

She had said that it is the Ombudsman, and not the DOJ, that has jurisdiction over such probes.

But the CA’s Special 6th Division ruled that De Lima was not able prove that failure of the court to release a TRO would result in irreparable damage.
