Makati prosecutor junks VAW-C case vs Cong. Albee Benitez

The Makati City Prosecutor’s Office has dismissed the violence against women and children (VAW-C) complaint filed against Bacolod Rep. Alfredo “Albee” Benitez by his former wife, Dominic “Nikki” Lopez, citing lack of evidence.

In a resolution released June 23, prosecutors found no prima facie evidence to pursue charges under Section 5(e)(1) and (2) of Republic Act 9262, or the Anti-VAWC Act of 2004.

“While this office commiserates with whatever complainant has gone through, the lack of evidence to support her case must be considered,” the resolution stated. It also noted that most of the complainant’s evidence was hearsay or based on online materials and news reports, which have no probative value.

The resolution was signed by Assistant City Prosecutor Mikhail Maverick P. Tumacder and approved by Acting City Prosecutor Melvin A. Matti.

Benitez welcomed the decision, calling it a form of vindication. In a statement, he said the dismissal proves that justice is alive in the country and urged the public, including the media, to respect their privacy as all parties move forward.
