FORMER Albay Gov. Noel Rosal assailed a Commission on Elections (Comelec) decision claiming it suppresses his rights to be a candidate in next year’s midterm polls.
Rosal charged that Comelec Resolution No. 11044-A cannot deny or cancel his certificate of candidacy, nor disqualify him from being a candidate since his case was still pending at the Supreme Court (SC).
Rosal was disqualified by the Office of the Ombudsman and has been awaiting final ruling on his motion before the SC.
He filed his certificate of candidacy last Oct. 3 under the Partido Demokratikong Pilipino party, along with his wife Geraldine who was also suspended as mayor of Legazpi City.
He maintained that the Comelec has no power to create laws since legislation is the duty of Congress.
