The Commission on Elections (Comelec) said preparations are progressing rapidly for the 2025 midterm elections, despite a Supreme Court (SC) order that did not include an injunctive writ.
The SC has instructed Comelec and South Korea’s Miru Systems Co. Ltd. to respond to a petition seeking to halt the implementation of the P18 billion Automated Election System contract for the upcoming polls.
Comelec chairperson George Garcia expressed relief and determination in light of the SC’s decision not to interfere with the election preparations.
“We are so elated that the High Court did not issue any injunctive writ,” Garcia said. He emphasized that without a Temporary Restraining Order (TRO) from the SC, the Comelec will continue its preparations for the May 2025 national and local elections.
The SC has given Comelec and Miru Systems 10 days from receipt of notice to submit their comments on the petition and the application for a TRO and/or writ of preliminary injunction.
Former Caloocan City Representative Edgar Erice filed the petition on April 18. Erice argued that the contract violates provisions of Republic Act 7369, or the Automated Election Law, particularly those related to bidding procedures and the use of prototype machines during elections.
Garcia said the Comelec will comply with the SC directive. “We will file the comment accordingly,” he assured.
