The Justice department has indicted of Dennis Sytin for the murder of his brother, businessman Dominic Sytin in March.
The department also found probable cause to file criminal charges against Edgardo Luib, the self-confessed gunman in the killing.
In its resolution, the DOJ said the three accused conspired to kill Dominic Sytin and injured his driver and bodyguard, Efren Espartero, in an ambush in front of the Lighthouse Hotel in Subic.
Justice Secretary Menardo Guevarra said the DOJ has asked the Supreme Court to transfer the venue for the proceedings from Olongapo City to Metro Manila.
Earlier, Dennis denied having planned the killing of his brother saying that he is not capable of murder.
“I have no derogatory record. I had no participation or involvement in the murder of my brother, Dominic. I have never met Luib. I did not socialize with Oliver [Fuentes] outside work,” Dennis insisted, referring to another co-accused.
The complaint filed against Sytin is principally based on the statement of Luib, who claimed that the businessman induced him to kill Dominic through Oliver Fuentes.
Contrary to the claim of Luib, Dennis said he was not at the All Hands Beach resort in Subic when they hatched the plan to kill his brother in September 2018.
Instead, Dennis accused Fuentes of being the mastermind behind the killing based on the evidence presented by the police.
He said Fuentes had a motive for having his brother killed, being a disgruntled employee when Dominic fired him in August 2018 for allegedly padding job orders and pocketing P1 million from United Auctioneers Inc. collections.
Dominic founded the auction company together with his brother.
In his extrajudicial confession, Luib identified Dennis as the mastermind and tagged Fuentes in the killing.
He said he was promised P1 million to kill Dominic, but was paid only P50,000.
