Double pay for workers on August 21

Workers who would report for work on Aug. 21 will be paid double their salary on that day after President Rodrigo Duterte declared the said day a special non-working holiday, the Department of Labor and Employment said.

The DoLE said Aug. 21 is a regular holiday as the country observes the Muslim Feast of Sacrifice, Eid’l Adha, which is also a special non-working holiday being the Ninoy Aquino Day.

But they will get to enjoy the double holiday pay only if they work on Aug. 21, the Labor department said.

Following the President’s proclamation, Labor Secretary Silvestre Bello III advised employers to observe the proper payment of wages for workers in a regular holiday falling on a special non-working holiday.

In Labor Advisory No. 12, Bello said the following pay rules will apply in the computation of workers’ wages on Tuesday pursuant to Proclamation Nos. 269 and 556 of July 17, 2017 and Aug. 15, 2018, respectively:

If the employee did not work, he or she shall be paid 100 percent of his or her salary for that day plus the cost of living allowance or cola.

However, if the employee worked on the said holiday, he or she shall be paid an additional 30 percent of 200 percent of his or her regular salary for that day for the first eight-plus COLA x 200 percent] + [30 percent (Daily rate x 200 percent)].

In addition, if the employee worked in excess of eight hours (overtime work), he or she shall be paid an additional 30 percent of his or her hourly rate on said day (hourly rate of the basic daily wage x 200 percent x 130 percent x 130 percent x number of hours worked).

The advisory also said that if the employee worked during a regular holiday that also falls on his or her rest day, he or she shall be paid an additional 50 percent of his or her daily rate of 200 percent [(daily rate + COLA) x 200 percent] + [50 percent (daily rate x 200 percent)].

Also, if the employee worked in excess of eight hours (overtime work) during a regular holiday that also falls on his or her rest day, he or she shall be paid an additional 30 percent of his or her hourly rate on said day (hourly rate of the basic daily wage x 200 percent x 150 percent x 130 percent x number of hours worked).
