Lawyer sues Sereno at Ombudsman

A lawyer has filed a complaint against Supreme Court (SC) Chief Justice Maria Lourdes Sereno at the Ombudsman today.

Attorney Eligio Mallari previously said he would initiate what is called a 'quo warranto' proceeding in which a person who is entitled to a position in dispute, through the Solicitor General or a public prosecutor, can file a case to remove a person from a post.

Mallari believes Sereno is illegally sitting as chief justice.

He claimed the chief magistrate failed to submit all her Statement of Assets, Liabilities and Net Worth (SALNs) when she applied for her position in 2012.

The Judicial and Bar Council (JBC) accepted her application and included her name in the shortlist of candidates submitted to then President Noynoy Aquino.

Mallari included as respondents in his complaint Aquino, JBC Executive Officer Annaliza Capacite and 2 other persons.

The lawyer was suspended by the SC for two years.

This was for allegedly preventing the Government Service Insurance System (GSIS) from foreclosing two parcels of land.

These properties were used by Mallari to secure a loan in 1968.
