The drug case against the late Albuera, Leyte Mayor Rolando Espinosa Senior has been dismissed.

Manila Regional Trial Court Branch 26 Judge Silvino Panfilo Jr. ruled that a criminal complaint against a person who has died is considered junked.

The mayor was shot dead while in detention in Baybay City Provincial Jail on November 5, 2016 during a raid conducted by the Philippine National Police-Criminal Investigation and Detection Group (PNP-CIDG).

Police claimed the mayor died in a shootout.

Espinosa's son Kerwin did not go through arraigment today for his drug cases.

This is because the court will first hear the motion to quash the information filed by the defendant.

The court set the arraignment for Kerwin on October 20, 2017.
