The trial of Former Senator Bong Revilla for plunder at the Sandiganbayan has been postponed for the second time.
During a hearing on Thursday morning, the court gave the prosecution panel 5 days to respond to the motion to quash the plunder case.
The motion was filed by Revilla last Monday.
In the plea, Revilla had claimed that the facts stated in the criminal complaint did not constitute plunder.
He said the accusations hurled against him could only fall under an offense of bribery and therefore, he said the plunder case must be dismissed.
Revilla was accompanied in the hearing by his lawyer Estelito Mendoza and son, Cavite Vice Governor Jolo Revilla.
For its part, the prosecution panel believes that Revilla only wants to further delay the proceedings.
This is why the former lawmaker supposedly filed the motion three days before the trial.
But Revilla’s counsel said, the motion can be filed anytime.
The trial was originally set last January 12.
Revilla has been detained in Camp Crame since June 2014.
He allegedly received P 224.5 million in kickbacks after his pork barrel was channeled to businesswoman Janet Napoles' fake non-government organizations.
