SC to gov’t: Answer habeas corpus petitions in 24 hours

The Supreme Court (SC) on Thursday has directed Executive Secretary Lucas Bersamin and other respondents to show cause within 24 hours “why the peremptory writ of habeas corpus should not issue”.

In total, the High Tribunal has received a total of three petitions filed by the Duterte siblings: Davao City Mayor Sebastian, a.k.a. ”Baste”, Davao City 1st District Rep. Paolo, a.k.a. Pulong, and Veronica, a.k.a. “Kitty”.

“The SC En Banc unanimously resolved to direct respondents in the consolidated petitions to show cause within a non-extendible period of 24 hours from receipt of notice why the peremptory writ of habeas corpus should not issue,” the SC Office of the Spokesperson said in a statement.

It has also unanimously resolved to consolidate the petition with the petitions for habeas corpus earlier filed.

Pulong filed Petition for Habeas Corpus, Certiorari and Prohibition before the SC to nullify the enforcement of the warrant of arrest issued by the International Criminal Court (ICC) against his father.

It challenges the actions of Bersamin, Interior and Local Government Secretary Juan Victor Remulla, Jr., and Philippine National Police Chief Major General Rommel Franciso Marbil in enforcing the ICC warrant against former President Rodrigo Roa Duterte.

The petition seeks to nullify these actions and prohibit further cooperation with the ICC and prays for a writ of habeas corpus to secure the release of the former President from his confinement and detention.

The lawmaker was granted travel authority by the House of Representatives to visit his father at The Hague.
