Purisima, Napeñas indicted for graft

THE Office of the Ombudsman has indicted ex-Philippine National Police Chief Alan Purisima and ex-Special Action Force director Getulio Napeñas for their involvement in the botched Mamasapano operation in 2015.

At least 44 members of the PNP’s Special Action  Force were killed in an encounter with Muslim fighters after they tried to serve arrest warrants on two international terrorists on Jan. 25, 2015.

The encounter followed an operation called Oplan Exodus that Aquino had approved and was implemented by Purisima and Napeñas, who were both suspended at the time.

Ombudsman Morales ordered the filing of graft and usurpation-of-authority charges against the two before the Sandiganbayan.

Morales also found Purisima and Napeñas liable for grave misconduct, gross neglect of duty and conduct prejudicial to the best interest of the service. 

Purisima was dismissed in June 2015 and Napeñas in July 2015. They were fined the equivalent of one year’s salary, perpetually banned from government service and had their retirement benefits canceled.  

“Purisima’s active participation and supervision of Oplan Exodus despite the 10 December 2014 preventive suspension order of the Ombudsman and the 16 December 2014 cease-and-desist order of OIC-PNP Chief Espina, both issued against him, violated the PNP chain of command and amounted to usurpation of official function,” the Ombudsman’s resolution read. 

Napeñas’ “constant reporting and official dealings with Purisima, notwithstanding the latter’s suspension, and sans the knowledge and approval of then-OIC PNP Chief Espina, made him liable as a cohort of Purisima in usurping official functions.”
