Palace: OICs, GOCCs can sign new contracts

Malacañang has allowed officers-in-charge (OICs), government-owned or -controlled corporations (GOCCs) and government instrumentalities to enter into new contracts or projects or disbursing extraordinary funds, with the exception of those involved in the food, transportation, and energy sectors.

Malacanang said Executive Secretary Lucas Bersamin signed   Memorandum Circular No. (MC) 9, revoking Item 4 of MC 3, which barred certain government agencies and instrumentalities from entering into new contracts or disbursing extraordinary funds to ensure the continuity of operations and the delivery of services.

All other provisions of MC 3 will remain in full force and effect, the order also read. 

MC 3 has extended the terms of designated OICs of departments, agencies, and bureaus until December 31, 2022.

Item 4 of the memorandum circular prohibited OICs, government-owned or -controlled corporations (GOCCs), and government instrumentalities from entering into new contracts or projects or disbursing extraordinary funds, with the exception of those involved in the food, transportation, and energy sectors.

“In order to ensure continuity in government operations and delivery of services to the public, and taking into account the assumption to duty of newly-appointed heads of government departments, agencies and instrumentalities, as well as the policy director provided by the Administration through, among others, the two 8-Point Socioeconomic Agenda and the Medium Term Fiscal Framework, Item 4 of MC 3 (s. 2022) is hereby revoked,” Bersamin  said.

Bersamin directed all government departments and agencies to strictly adhere to the Government Procurement Reform Act and ensure the prudent use of state resources, as well as strict adherence to the ethical norms of honesty, integrity, and efficiency in contract execution and fund disbursement.

The new MC considers the Marcos administration’s 8-Point Socioeconomic Agenda and the assumption of newly appointed heads of government departments, agencies, and instrumentalities.

Under MC 9, when entering and executing contracts and disbursing funds, the concerned authorities must strictly comply with the Government Procurement Reform Act and applicable budgeting, accounting, and auditing laws and issuances.

They must also ensure judicious use of government resources and strictly observe ethical norms of honesty, integrity, and efficiency
