Comelec to review law on substitutions after May polls

The Commission on Elections (Comelec) will review a bill seeking to amend election laws regarding withdrawal as a basis for a candidate’s substitution after the May 2022 elections.

“Among the things we should also review after this election is the issue on nuisance candidates, substitution, withdrawals, et.,” Comelec Commissioner George Garcia, quoted in a GMA News report said.

Garcia also noted that the poll body previously reviewed a pending Senate bill that seeks to amend the substitution of candidates in case of a withdrawal.

“Others say that withdrawal is being abused, they say that withdrawal with substitution should not be allowed, because it’s as if giving false hope to people,” he further said.

The official said the Comelec should study the proposed amendments to determine if the law on withdrawal is really being abused.

Garcia said this will determine the position that the Comelec will submit in Congress.

The official said that Comelec will implement the law that lawmakers in Congress would pass.

“In the final analysis, Congress has the final say of what the law should really be. We are only there to implement what they want us to do,” he said.
