The Supreme Court will conduct the oral arguments for the petition of Senator Leila De Lima seeking to void the warrant of arrest issued for her by Muntinlupa Regional Trial Court (RTC) Judge Juanita Guerrero.
The proceeding will begin at 2 pm on Tuesday.
Former Solicitor General Florin Hilbay will lead De Lima’s team of lawyers.
Solicitor General Jose Calida will argue on behalf of the Department of Justice which filed the charges at Muntinlupa RTC.
The two sides will each be given 10 minutes before the justices subject them to interpellations.
De Lima is also seeking to stop the lower court from hearing the drug charges.
She insists that the cases should be filed at the Sandiganbayan since she is a government official.
But Calida maintains, drug-related complaints are under the jurisdiction of regional trial courts.
