Napoles daughter makes no plea

THE Court of Tax Appeals   on Wednesday   entered  a “not guilty” plea on behalf of  Jeane Catherine Napoles in connection with a consolidated tax evasion suit for her failure to file income tax returns  to the tune of  P17,461,038.40.

 The daughter of suspected pork scam mastermind Janet Napoles, refused to enter a plea during her arraignment.

“As advised by my counsel, I refuse to enter any plea,” she told the Third Division. Jeane Catherine, along with her lawyers, arrived at the tax court, covering her face with a folder, and immediately left the courtroom right after the arraignment.

The tax court junked her plea to defer yesterday’s arraignment due to a pending petition for review filed with the Department of Justice.

 Janet Lim Napoles  is now detained at the Correctional Institute for Women in Mandaluyong for serious illegal detention filed her cousin-whistleblower Benhur Luy in the P10-billion Priority Development Assistance Fund scam involving three senators.

According to Associate Justice Esperanza Fabon Victorino, under the rules, the petition for review must be resolved within 60 days, but Jeane Catherine’s petition has already lapsed since it has been pending for 100 days.

The court also dismissed Jeane Catherine’s motion to dismiss the judicial determination of probable cause.

On the other hand, she was granted to consolidate her two counts of tax suit. A preliminary conference is set on   July 14.

On   July 29, the tax court also summoned Jeane Catherine to a pre-trial conference.

The Department of Justice sued her for violation of Section 255 of the National Internal Revenue Code over her failure to file, provide correct and accurate information, and pay tax.

Last March, Jeane Catherine posted a P50,000 bail.

The tax court ordered her arrest for failure to appear for her arraignment originally set in May.

Days later, she showed up, prompting the court to lift her warrant.
