Clark firm denies forcible takeover of Tarlac landfill

State-run Clark Development Corp. (CDC) refuted claims of a forcible takeover of the Kalangitan Sanitary Landfill, saying its actions were lawful and in line with its regulatory duties.

CDC issued a cease-and-desist order (CDO) to Metro Clark Waste Management Corp. (MCWMC), the landfill operator, on Oct. 25, 2024, directing them to vacate the property and return it to the government peacefully.

The agency said it rendered the CDO following MCWMC’s 25-year build-operate-transfer contract expiration on Oct. 6, 2024.

CDC also ordered MCWMC to cease all operations at the landfill and process the necessary clearance for removing its movable properties.

The agency said its actions were aligned with its mandate to regulate enterprises within the Clark Freeport and Special Economic Zones, as outlined in Republic Act No. 7227, Executive Order No. 80, and other relevant laws.

The Angeles City Regional Trial Court dismissed a case filed by MCWMC against CDC and the Bases Conversion and Development Authority (BCDA), finding it to be without merit.

The court confirmed that the 25-year contract between the parties expired on Oct. 5, 2024, and could not be extended.

CDC asked all stakeholders to rely on verified information and avoid spreading unfounded allegations.
