Metro Pacific Tollways Corp. (MPTC) on Monday acknowledged reports on a case filed by PEA Tollway Corp. (PEATC) against its subsidiary Cavitex Infrastructure Corp. (CIC).
CIC is the joint venture partner of the Philippine Reclamation Authority (PRA) for the Manila-Cavite Toll Expressway Project (CAVITEX).
“We understand this is a matter of public interest, and we would like to address the concerns with clarity and transparency,” MPTC said in a statement.
The company said that as the project is a joint venture with the PRA, any legal dispute involving CIC should have included the PRA as an indispensable party. MPTC said that the petition against CIC was filed by Dioscoro Esteban Jr., officer-in-charge of PEATC, who lacked the authority of the PRA or its board to do so.
“This misrepresentation is further evidenced by the absence of the imprimatur of the Office of the Government Corporate Counsel (OGCC), the rightful counsel of a government-owned and controlled corporation (GOCC) such as PEATC,” MPTC said.
