Power distributors get one-year leeway

Distribution utilities affected by the Supreme Court ruling on the competitive selection process can seek a one-year leeway to comply with the decision and continue to serve their consumers, according to the Energy Department.

“Distribution utilities with PSAs that have been invalidated by the SC decision can apply for CSP exemption as provided by the 2018 department circular. The exemption will only be for one year so they will still have to supply for one year while they conduct the CSP to replace the contracts affected by the SC decision,” Energy assistant secretary Redentor Delola said.

The department issued a CSP advisory to guide industry stakeholders on the way forward following the Supreme Court’s decision on the petition of Alyansa Para sa Bagong Pilipinas Inc. against the Energy Regulatory Commission.

The high court’s decision is seen to affect 99 PSA contracts that supply power to 52 distribution utilities serving 13 million electricity consumers nationwide.
