Peco seeks TRO vs More Electric

Panay Electric Co. sought a temporary restraining order with the Mandaluyong Regional Trial Court  to stop More Electric Power Corp. from expropriating and taking over its distribution assets.

Peco, through its legal counsel Divina Law, said it was seeking relief from Republic Act No. 11212, specifically Section 10 and 17 that authorizes More to exercise the power of eminent domain over the distribution assets of Peco existing at the franchise area in Iloilo City. 

“The authority granted to respondent More for the taking of petitioner’s Peco’s assets is arbitrary and confiscatory. The law authorizes taking that is not for public purpose,” Peco said in its petition.

Peco said the immediate transfer of its distribution assets to More would pose problems that may result in inefficiency of public service and detrimental to the people of Iloilo.

Peco corporate affairs manager Mikel Afzelius earlier said that  if More tried to expropriate Peco’s assets, then Peco would exert all legal remedies to protect itself.

“More again can put up its own facilities and run a power distribution business but they cannot and should not expropriate Peco’s assets. The only way they can use Peco’s assets if there is a legal sale between Peco and More which to this date there is no agreement between the two parties,” he said.
